- dependence upon public confidence or trust for value
- a person that holds a trusted relationship or acts in a trusted capacity
- a person who manages money or property for someone else (a beneficiary)
- the law requires a fiduciary to manage the beneficiary's money & property for the beneficiary's benefit, not the benefit of the fiduciary
